On 9/30/2022 Waste Management of Wisconsin, Inc submitted Addendum #2 in response to the DNR’s 3/23/2022 Incompleteness Letter for the Orchard Ridge Eastern Expansion, Southern Unit Plan of Operation
On 9/29/2022 the DNR and EPA issued the Fifth Five-Year Review Report on the Lauer I Landfill Superfund site (aka BRL Superfund site).
On 9/16/2022 Waste Management of Wisconsin, Inc submitted Addendum #1 in response to the DNR’s 3/23/2022 Incompleteness Letter for the Orchard Ridge Eastern Expansion, Southern Unit Plan of Operation.
Public Notice Issued 7/31/2022 - A Public Notice and Fact Sheet on the DNR and EPA’s Five-Year Review for the Boundary Road Landfill Superfund Site (a.k.a Lauer 1 Sanitary Landfill Superfund Site) in Menomonee Falls has been issued. The notice provides an opportunity for community members and other stakeholders affected by the Boundary Road Superfund Site to express an interest in forming a Community Advisory Group (CAG) for the Boundary Road Superfund Site as well as an opportunity to submit comments on Boundary Road to the DNR and EPA.

Comments on the formation of a CAG can be submitted to BJ LeRoy at BJ.LeRoy@wisconsin.gov. The DNR is asking those interested in forming a CAG to include “BRL CAG Interest” in the subject line. Comments must be submitted by August 30, 2022. For more information on CAGs see Superfund and Community Advisory Groups.
(WEAL will be expressing an interest in forming a CAG and will submit comments on the Five-Year Review for the Boundary Road Superfund site.)
Upcoming Public Notice - The WI DNR is expecting to issue a public notice in the Milwaukee Journal Sentinel on 7/31/2022 for the DNR’s and EPA’s Fifth Five-Year Review Report on the Boundary Road Landfill Superfund site (aka Lauer I Landfill Superfund site). The public notice will also offer an opportunity to form a Community Advisory Group (CAG) for the Boundary Road Superfund site that will be crucial for monitoring the site and keeping the public informed. The public notice will be posted on this website.
UPDATE: On 5/18/2022 the DNR sent comments to Waste Management on the February 2022 Property Redevelopment Plan for the Boundary Road Superfund site. The Property Redevelopment Plan and 5/18/2022 DNR letter are posted on the Bureau for Remediation and Redevelopment Tracking System (BRRTS) website. The Redevelopment Plan can also be viewed in Appendix C of the Orchard Ridge Eastern Expansion, Southern Unit Plan of Operation (see link below).
On 3/23/2022 the Wisconsin DNR sent an “Incompleteness Letter” to Waste Management on the Orchard Ridge Eastern Expansion, Southern Unit Plan of Operation. The 15-page letter includes 27 requirements and 24 areas where more information is needed before the DNR can determine the POO is complete or make a decision on approval.
Information on the Plan of Operation (POO)
The Orchard Ridge Eastern Expansion, Southern Unit (Boundary Road Superfund site exhumation and expansion) POO was submitted to the DNR on 2/18/2022 by Waste Management of Wisconsin, Inc. (WMWI).

The POO is a large document which can be reviewed in sections starting with an Executive Summary. The POO contains 20 appendices.

The department is currently reviewing the Plan of Operation submitted by WMWI for the proposed Orchard Ridge Eastern Expansion, Southern Unit. The procedures specified in s. NR 514.04, Wis. Adm. Code, do not require the department publicly announce or post the Plan of Operation. However, the department recognizes the unconventional elements of this proposal, and the unique level of public interest on this project. Therefore, the department has posted an electronic copy of the Plan of Operation on its website at the following locations (and please note document downloads may take a while):

WEAL ACTION ALERT AB-40/SB-27 Budget & Recycling WEAL is asking you to contact Governor Walker and your State Legislators tomorrow, Monday, April 4, 2011, regarding AB-40/SB-27, the proposed Budget Bill which eliminates the recycling mandate and ends recycling grants. The state will continue collecting a $7.00 per ton "recycling fee" for landfilling garbage. However, these funds will no longer be directed to grants for community recycling programs. Under the proposed budget, the money will be going into a new economic development fund. WEAL does not believe it is fair for communities to pay recycling fees at landfills when the money will not benefit recycling. Suggested Action: Please contact Governor Walker and your Legislators tell them you do not support the proposed changes. Let them know recycling preservers resources, conserves energy, limits dependence on landfills, creates jobs, contributes to economic development and is an effective method for communities to reduce disposal costs.
